AFP-UT Response to Court Ruling on Scholarship Program

SALT LAKE CITY, UT – Americans for Prosperity-Utah (AFP-UT) doubled down on its support for universal school choice and the Utah Fits All Scholarship program today following a hearing that will allow the program to continue while a case challenging its constitutionality heads to the Utah Supreme Court.

AFP-UT State Director Kevin Greene issued the following statement: 

“This week’s ruling against the Utah Fits All Scholarship is a saddening setback for parents across Utah who had fought for years for the freedom to give their children the best education possible, but we’re optimistic that the Utah Supreme Court will decide once and for all that families should be in the driver’s seat of their children’s education. We’re grateful to Governor Spencer Cox’s commitment to appeal the case.

“This lawsuit shows that some people care more about control than our students and that they will stop at nothing to protect one-size-fits all education.

“AFP-UT remains committed to ensuring that all children in Utah have access to the education options they need to thrive.”  

Background: 

AFP-UT was a leading proponent of expanding the Utah Fits All Scholarship in the 2025 legislative session, where lawmakers approved a $20 million funding increase to the program.
