HELENA, MT — Americans for Prosperity-Montana (AFP-MT) today announced its opposition to I-194, a statewide ballot measure that would strip Montana small businesses, family farms and ranches, and nonprofit organizations of their right to speak up in the political process — and put their ability to legally operate in the state on the line if they don’t comply.
AFP-MT State Director Jesse Ramos issued the following statement:
“I-194 is a government power grab to silence Montanans, and it’s far more draconian than its backers are letting on. This isn’t a contribution limit or a disclosure requirement — it’s a flat ban on any Montana business, nonprofit, or organization spending a dime to weigh in on a candidate, a party, or even a local ballot issue. And if you cross that line, the state doesn’t just fine you — it can strip your organization of the legal right to do business in Montana at all.
“That’s not reform. That’s the government deciding which Montanans are allowed to have a voice, backed by the threat of losing the ability to operate legally. Small business owners, family farmers, ranchers, and local nonprofits shouldn’t have to choose between speaking up for their communities and their right to keep their doors open.”
BACKGROUND:
I-194 would bar corporations, nonprofits, LLCs, unions, trade associations, and other Montana organizations, classified in the measure as “artificial persons,” from spending to support or oppose candidates, political parties, or any state or local ballot issue.
Unlike traditional campaign finance law, which regulates political spending through contribution limits or disclosure requirements, I-194 imposes an outright prohibition on the underlying speech itself. And the penalty for violating it isn’t a fine — it’s forfeiture of the organization’s legal privileges to do business in Montana, including limited liability and perpetual existence, with restoration only at the state’s discretion.
