AFP-GA Celebrates Senate Passage of HB 1247, the Georgia Bureaucratic Deference Elimination Act

ATLANTA, GA – Americans for Prosperity-Georgia applauds the Georgia Senate for passing HB 1247, the Georgia Bureaucratic Deference Elimination bill, today. The 2024 U.S. Supreme Court decision Loper Bright Enterprises v. Raimondo ended the Chevron doctrine at the federal level, and HB 1247 would end judicial deference at the state level. The bill would instruct Georgia courts to interpret statutes and regulations without bias in favor of any agencies. If signed into law, Georgia will join the 19 other states that have passed judicial deference since the 2024 decision.

The Senate also added the Red Tape Rollback Act of 2026 to HB 1247. This bill will increase transparency and accountability when agencies promulgate new rules and regulations, as well as require a regular review of existing rules to ensure Georgia lawmakers and the public has a clearer picture of the depth and breadth of Georgia’s regulatory state.

“We thank Senator Hatchett for championing HB 1247 in the Senate. This legislation will ensure that the opinions of state bureaucrats do not take precedence over what the law dictates. It also increases transparency and accountability in the rulemaking process, so lawmakers can be more responsive to constituents when they have concerns about overburdensome regulations . We hope Governor Kemp quickly signs this legislation into law.”
