AFP Applauds Utilizing Congressional Review Act and Introduction of H.J. Res. 88 and Other Bills to Counter Biden EPA Overreach

Action Needed to Prevent Ban on Internal Combustion Engine in California by 2035 and Force Electrification on all Americans

Washington, DC – Americans for Prosperity applauds the introduction of three resolutions to stop overreach by the Biden Administration’s EPA in granting waivers to California’s politically motivated environmental rules that would have ripple effects across the country.  Enacted by Congress in 1996, the Congressional Review Act (CRA) places checks on executive overreach, especially when rules negatively impact millions of Americans without congressional consent.

H.J. Res. 88 (Congressman John Joyce, PA-13) would repeal the “California State Motor Vehicle and Engine Pollution Control Standards; Advanced Clean Cars II” Clean Air Act waiver issued by the EPA that would eliminate the internal combustion engine from sale in California by 2035.  AFP also commends and supports H.J. Res. 89 (Congressman Obernolte, CA-23) which prevents unworkable standards for heavy-duty on-road engines in California and H.J. 87 (Congressman James, MI-10) to stop a California mandate of zero-emission trucks.

“On behalf of millions of Americans for Prosperity grassroots activists across the country, we applaud the introduction of H.J. Res. 88, H.J. Res. 89, and H.J. Res. 87 to undo California’s EPA waivers that exceed certain emissions standards under the Clean Air Act and to stop the elimination of the internal combustion engine,” said Brent Gardner, AFP’s Chief Government Affairs Officer and Senior Vice President. “By providing a waiver to California to eliminate certain products from the marketplace, the Biden Administration’s Environmental Protection Agency overstepped its authority by peddling politically motivated rules from CARB to force an EV transition. Congress has a keen legislative interest in preserving uniformity in how major industries are regulated, and the CRAs introduced by Mr. Joyce, Mr. James, and Mr. Obernolte provide certainty for critical domestic auto manufacturers in the United States to stop the ban on the internal combustion engine.”
