AFP-SC Key Vote Alert: Support a Favorable Subcommittee Report on H.3021 / S.254

Dear Senator,

On behalf of our volunteers and supporters across South Carolina, I respectfully urge you to vote YES on H.3021/S. 254, the Small Business Regulatory Freedom Act, and to give the bill a favorable report out of the Senate Judiciary Subcommittee. This vote may be recorded in our 2026 legislative scorecard.

H.3021/S. 254 restores accountability by ensuring that major regulations are reviewed and approved by the Legislature—the branch constitutionally responsible for making law. Importantly, regulatory accountability and public safety are not in conflict. The bill strengthens both by ensuring essential health and safety regulations rest on clear legislative authority and remain subject to ongoing oversight.

The legislation also appropriately limits judicial deference to agency interpretations, reaffirming that courts—not regulators—are responsible for interpreting the law as written by the General Assembly.

With more than 80,000 regulatory restrictions already on the books in South Carolina, this reform helps prevent unchecked regulatory growth while preserving the Executive Branch’s ability to act in emergencies.

As the bill advances, we respectfully urge you to support only those amendments that strengthen the bill—and oppose any changes that would weaken its core requirement that major regulations come before elected lawmakers for a vote.

For these reasons, we ask for your YES vote on H.3021/S. 254 and your support for a favorable report out of subcommittee.
