Letter of Support: Reining In EPA and Army Corps “Wetlands” Regulators

In recent years, however, the EPA and the Army Corps have attempted to expand their jurisdiction to impose stringent new regulations on isolated wetlands, ephemeral streams, farm runoff and drainage, and other “waters” in the U.S. that are arguably not at all connected to navigable waters nor interstate commerce. A recent guidance document, for example, tries to circumvent both Congress and multiple Supreme Court rulings on wetlands regulation.

Democrats Abdicate Responsibility with REINS Vote

December 08, 2011 J

Americans for Prosperity issued the following statement today in response to the House vote on the REINS Act:

“We commend the work of Rep. Geoff Davis and the Republican leadership for passing this critical reform to restore accountability and constitutional balance to the federal regulatory process,” said AFP VP Policy Phil Kerpen. “This is a major victory for the American people and we urge the Senate to take up and pass this bill as soon possible.”

The House voted 241-184 to pass H.R. 10, the Regulations from the Executive in Need of Scrutiny Act (REINS) Act. Republicans unanimously supported the bill, which requires Congress to vote on economically significant regulations before they can take effect. Democrats overwhelmingly opposed the bill, with 184 voting against it and only four voting for it.

She spoke about this perverse exploitation of the “EAJA” by many in the environmental community. Let us help her and others correct this wrong.

Chalk one up for the good guys who are trying to bring transparency and accountability for the amount of taxpayer dollars paid in attorney fees. The bill to return the Equal Access to Justice Act (“EAJA”) to its original intent has crossed its first giant hurtle–passage through the House of Representatives Judiciary Committee!! Now we need your help to get this bill through the full U.S. House.

Last month at a gala for the Congressional Hispanic Caucus Institute, President Obama said: “I wish I had a magic wand and could make this all happen on my own...There are times where — until Nancy Pelosi is speaker again, I’d like to work my way around Congress."

This week, Mr. Obama is moving forward to do precisely that.
