Dear Senators:
On behalf of more than 2.8 million Americans for Prosperity activists in all 50 states, I write to you in strong support of protecting property rights by stopping the overreach of the Environmental Protection Agency (EPA) and Army Corps of Engineers and their controversial Waters of the United States Rule (WOTUS).
We urge you to VOTE YES on S.1140 which protects Americans’ private property rights from overregulation. Americans for Prosperity will include this vote in our congressional scorecard.
The WOTUS rule drastically expands the authority of EPA and Army Corps of Engineers under the Clean Water Act. It changes the definition of “navigable waters,” and bodies of water that affect them, to potentially include ditches, creeks, and ponds on private land as well as land owned by state and local governments. Bodies of water that will likely never flow navigable waters. The costs of the rule would be enormous. Landowners would suddenly be subjected to the EPA’s Kafkaesque permitting process if they wish to make changes to even the smallest bodies of water on their property.
This legislation will require the EPA and Army Corps of Engineers to restart the rulemaking process for WOTUS and excludes small bodies of water that do not flow into navigable waters from being included in the rule. It will also require both agencies to engage more with state, local, and tribal governments in the rulemaking process; giving those closest to the bodies of water being regulated more of a voice.
