Official Rules for the AFP-Wisconsin, Brown, Fond du Lac, Outagamie, Winnebago, and Sheboygan Counties iPad Giveaway Phonebank Competition

Rules for Contest: By participating in this Contest, Participants agree to be bound by these Official Rules and the final decision of the Contest.  Decisions by Americans for Prosperity (AFP) – the sponsor of this competition – are binding and final in every respect.

Eligibility: Americans for Prosperity’s (Wisconsin Office) iPad Giveaway Competition is open to all legal U.S. residents physically residing in Brown, Fond du Lac, Outagamie, Winnebago, and Sheboygan Counties, Wisconsin. Participants must be at least the age of majority at the time of participation.  This Contest is subject to all applicable federal, state and local laws.  Void where prohibited.

To participate in this Contest, Participants must obtain phonebanking instructions and a unique personal identifier number (PIN), which will be used to track their phonebanking activities, and participate in the phonebanking activities during the Contest Period. Instructions and PINs may be obtained by contacting Nate Nelson at nnelson@afphq.org or (414) 731-7726.

The top three (3) phonebanking participants who complete the most telephone surveys during the Contest Period, as determined by AFP in its sole discretion, will each receive one (1) of the following prizes: 1) First place –New Apple iPad-32GB with WIFI and cellular (service is the responsibility of winner-sold separately); 2) Second place – $200 Cabelas Gift Card; 3) Third Place – $100 Kwik Trip Gas Card.

The prizes do not include any expenses related to using or redeeming the prize.  The prizes are not redeemable for cash.

Each Participant is limited to one prize from AFP from this Contest and any other simultaneous AFP Contest.  Employees, contractors, employees of contractors, subcontractors, agents, board members, and any other individuals otherwise compensated by AFP or any of its affiliates or subsidiaries are not eligible to participate in this AFP Contest.  In no event will AFP be liable for more prizes than outlined in the Contest Details.  Prizes are non-transferable and non-negotiable.

AFP is not responsible for any problems, bugs, or malfunctions Participants encounter when participating in the Contest.

Contest Period: The Contest Period begins at 9AM (CDT) on October 16, 2012 and ends at 9PM (CDT) on November 10, 2012.

Publicity: AFP reserves the right to use for publicity purposes prior to, during, or after the Contest Period, in any media, the Participant’s name, likeness, and city name throughout the world, in perpetuity, without any compensation or prior review, unless specifically prohibited by law.

Taxes: Except as noted above, it is the sole responsibility of the winning Participant to pay all federal, state, and local taxes in connection with the prize.

Privacy Policy: Participant membership information will be handled in compliance with AFP’s Privacy Policy at http://americansforprosperity.org/privacy-policy/ and Terms of Use Policy at http://americansforprosperity.org/terms-of-use/.

Limitation of Liability, Governing Law, and Venue: Participant agrees to indemnify, defend, and hold harmless AFP from any loss, liability, damage, or costs, including court costs and legal fees, which result from the Participant’s involvement and participation in the Contest or Participant’s receipt or use of the prize.  In no event shall AFP be liable to Participant for special, indirect, incidental, or consequential damages, including without limitation, loss of use of profits, regardless of whether such damages are caused or allegedly caused by breach of contract, tort or otherwise (including negligent or willful act or omission, warranty, indemnity, or strict liability).  This agreement shall be governed by the laws of the Commonwealth of Virginia without regard for conflict of laws doctrine.  Participants agree that any legal action arising in connection with the Contest, whether in tort, contract, or otherwise, shall be heard exclusively in the courts of the Commonwealth of Virginia.

Waiver of Jury: As a condition of participating in this Contest, each Participant hereby irrevocably and perpetually waives any right that Participant may have to a trial by jury in respect of any litigation directly or indirectly arising out of, under, or in connection with the Contest, any document or agreement entered into in connection with the Contest, any prize available through the Contest, and any of the transactions contemplated related to the Contest.

Termination: AFP reserves the right, in their sole discretion, to cancel, modify, or suspend the Contest at any time.

Trademark: Americans for Prosperity® is a registered trademark of Americans for Prosperity Foundation.  The Contest is in no way sponsored, endorsed, or administered by Americans for Prosperity Foundation. “Apple”, “iPad”, “Cabelas”, and “Kwik Trip” are trademarks of their respective owners and are not affiliated in any way with Americans for Prosperity or Americans for Prosperity Foundation.
