Senate Key Vote: Vote YES to Overturn the NLRB's "Ambush" Elections Rule

Dear Senators,

On behalf of more than two million Americans for Prosperity activists in all 50 states, I urge you to support S.J.Res. 36, a resolution to disapprove of the National Labor Relations Board’s (NLRB) “ambush” elections rule. Currently, 95 percent of union elections were held within 56 days after a petition was filed, an entirely reasonable timeframe. Changing representation election procedures to shorten that timeframe to as little as 10 days is merely a ruse to force workers into unions before they’ve had a chance to fully consider all relevant information.

I urge you to vote YES on S.J.Res. 36, disapproving of the NLRB’s “ambush” union elections rule. Americans for Prosperity will rate this vote in our congressional ratings.

Dismayed that private-sector unionization is declining nationwide, the NLRB has decided to change the rules of the game. Disguising their efforts as merely “streamlining out-dated procedures,” what they have really done is accelerate the election process to effectively prevent employers from marshalling an effective response campaign. This is not only bad for employers, who are unable to clear up misconceptions and otherwise communicate their case to employees, but also bad for workers, who are given little time and incomplete information from which to make this important decision affecting their employment.

When given time to consider all of the arguments, including those from their employer, workers frequently reject union organizing campaigns. They do so because they realize collective bargaining is bad for business, rarely delivers on its promises, and does not advance workers’ interests effectively. If the NLRB wants to maintain its status as an objective referee in representation elections, it must go back to the drawing board to rewrite this misguided rule.

I urge you to vote YES on S.J.Res. 36, disapproving of the NLRB’s “ambush” union elections rule. Americans for Prosperity will rate this vote in our congressional ratings.
