Official Rules for the AFP-Colorado Phone Bank Contest

Rules for Contest: By participating in this Contest, Participants agree to be bound by these Official Rules and the final decision of the Contest. Decisions by Americans for Prosperity (AFP) are binding and final in every respect.

Eligibility: Americans for Prosperity’s Phone Bank Contest is open to all legal U.S. residents physically residing in Colorado. Participants must be at least the age of majority at the time of participation. This Contest is subject to all applicable federal, state and local laws. Void where prohibited.

To participate in this Contest, Participants must appear at one of the AFP-Colorado phone banks occurring in that region of the state and participate in the phone banking activities. The top phone banking participant for that region of the state, as determined by AFP in its sole discretion, will qualify for a travel scholarship to Americans for Prosperity Foundation’s RightOnline® Conference in Las Vegas, Nevada held from June 15-16, 2012. The travel scholarship is limited to RightOnline registration fees for winner and guest, paid air transportation for winner and guest (up to $500 inclusive of both fares and all fees and charges), and hotel accommodations for winner and guest (double occupancy). The maximum value of the prize is $1000.00 and is not redeemable for cash.

A Participant is limited to one prize from AFP from this Contest and any other simultaneous AFP Contest. Employees, contractors, subcontractors, agents, board members, and any other individuals otherwise compensated by AFP or any of its affiliates or subsidiaries are not eligible to participate in this AFP Contest. In no event will Sponsors be liable for more prizes than outlined in the Contest Details. Prizes are non-transferable and non-negotiable.

Contest Period: The Contest Period begins with the start of the first Phone Bank in the region and ends when the final Phone Bank closes for the region where the contest is being held.

Publicity: Sponsor reserves the right to use for publicity purposes prior to, during, or after the Contest Period, in any media, the Participant’s name, likeness, and city name throughout the world, in perpetuity, without any compensation or prior review, unless specifically prohibited by law.

Taxes: It is the sole responsibility of the winning Participant to pay all federal, state, and local taxes in connection with the prize.

Privacy Policy: Participant membership information will be handled in compliance with AFP’s Privacy Policy and Terms of Use Policy at http://www.americansforprosperity.org/about/legal.

Limitation of Liability, Governing Law, and Venue: Participant agrees to indemnify, defend, and hold harmless Sponsor from any loss, liability, damage, or costs, including court costs and legal fees, which result from the Participant’s involvement and participation in the Contest or Participant’s receipt or use of the prize. In no event shall AFP be liable to Participant for special, indirect, incidental, or consequential damages, including without limitation, loss of use of profits, regardless of whether such damages are caused or allegedly caused by breach of contract, tort or otherwise (including negligent or willful act or omission, warranty, indemnity, or strict liability). This agreement shall be governed by the laws of the Commonwealth of Virginia without regard for conflict of laws doctrine. Participants agree that any legal action arising in connection with the Contest, whether in tort, contract, or otherwise, shall be heard exclusively in the courts of the Commonwealth of Virginia.

Waiver of Jury: As a condition of participating in this Contest, each Participant hereby irrevocably and perpetually waives any right that Participant may have to a trial by jury in respect of any litigation directly or indirectly arising out of, under, or in connection with the Contest, any document or agreement entered into in connection with the Contest, any prize available through the Contest, and any of the transactions contemplated related to the Contest.

Termination: Sponsor reserves the right, in their sole discretion, to cancel, modify, or suspend the Contest at any time.

Trademark: RightOnline® is a registered trademark of Americans for Prosperity Foundation. The Contest is in no way sponsored, endorsed, or administered by Americans for Prosperity Foundation.
