AFP Supports State Authority Over Hydraulic Fracturing

Dear Representative Flores:

On behalf of more than two million Americans for Prosperity activists in all 50 states, I applaud you for introducing the Protecting States’ Rights to Promote American Energy Security Act (H. R. 2728). This legislation would assert states’ authority to regulate hydraulic fracturing and protect the natural gas revolution that is improving Americans’ access to affordable energy.

The United States is increasingly a global leader in energy production thanks to increases in drilling technologies, recent discoveries of natural gas reserves in shale rock, and a lack of federal regulations directly related to hydraulic fracturing. Even more importantly, hydraulic fracturing benefits American families by reducing the cost of utilities and producing well-paying jobs. State agencies are better equipped to oversee hydraulic fracturing than the federal government because they are more proximate to and understand the unique needs of the energy sector. Federal oversight would threaten this critical industry’s rapid progress.

Your legislation would ensure that state governments maintain control over the regulations, permitting, and guidance related to hydraulic fracturing. It prohibits the Department of the Interior from enforcing regulations of hydraulic fracturing in states that have laws and regulations of their own. In addition, your legislation establishes a definition for this technology that complies with state regulations.

Ensuring American’s access to affordable energy is paramount to economic growth. Americans for Prosperity is proud to support your legislation to allow states governments to maintain authority of hydraulic fracturing at the state level.
